1. Description of Service

These Terms of Service are applicable to all users of BLAZE Activate, an online activation, wellness, and personal development platform providing services through its website located at blazeactivate.com, mobile applications, desktop applications, and connected TV applications (individually and collectively the “Services”). These Terms govern your use of the Services, including all functionalities, features, audio activations, video content, written materials, community features, live events, courses, and all content and software associated with the Services as provided by Wildfire Enterprise, LLC (the “Company”).

2. THIS SERVICE DOES NOT PROVIDE MEDICAL CARE

BLAZE Activate provides activation and wellness content for general personal development purposes only.

We do not provide medical advice, diagnosis, or treatment, nor are we a medical service provider. Content on the Services, which may include audio activations, text, graphics, images, or other information produced by us or obtained from third-party content providers, is for informational and personal development purposes only.

Nothing on this platform is intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, licensed therapist, or other qualified healthcare provider with any questions you may have regarding a medical or mental health condition.

Never disregard professional medical advice or delay in seeking it because of something you have heard, seen, or experienced through the Services. If you think you have a medical or mental health emergency, call your doctor, 988 (Suicide & Crisis Lifeline), or 911 immediately.

BLAZE Activate is not therapy, counseling, or mental health treatment. Our activations focus on mindset, personal development, empowerment, and manifestation. If you are experiencing mental health issues, trauma, or require therapeutic intervention, you should seek services from a licensed mental health professional.

We do not recommend or endorse any specific tests, products, procedures, opinions, or other information that may be made available to you through the Services. Reliance on any information provided by us is solely at your own risk.

3. Acceptance and Changes to Terms

The Company shall have the right, at its sole discretion, to modify, add, or remove any terms or conditions of these Terms of Service without notice or liability to you. Any changes to these Terms of Service shall be effective immediately following the posting of such changes.

You agree to review these Terms of Service from time to time and agree that any subsequent use by you of the Services following changes to these Terms of Service shall constitute your acceptance of all such changes.

4. Access and Use of Service

Users accessing the Services must be at least thirteen (13) years of age. Users registering for the Services, participating in community features, and accessing live events must be at least eighteen (18) years of age.

The Company makes no claims that the Services may be lawfully accessed in any specific location. When you access the Services you are solely responsible for compliance with the laws and regulations of your jurisdiction.

The Company grants you a limited, non-exclusive license to access and use the Services for your own personal and non-commercial purposes. This includes rights to stream and listen to audio activations, view content, and participate in community features through Company’s website and applications.

5. Subscription Terms

5.2 Free Trial

New subscribers may be eligible for a free trial with full access to the Services. Your payment method will be charged at the end of the trial period unless you cancel before the trial ends.

5.3 What’s Included

All subscriptions include access to: - Full activation library - The His Voice Collection - Wildfire Collective community - WildFIRE Collective Live monthly sessions - Available courses - and New content as released

5.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel. You authorize us to charge your payment method on file for each renewal period.

6. Payments and Billing

By subscribing to BLAZE Activate, you expressly agree that we are authorized to charge your selected payment method. You can update or change your payment information at any time by logging into your account settings.

Receipts are sent to your registered email address once payment is successful.

The Company reserves the right to change subscription prices at any time. Price changes will be communicated in advance and will apply to your next billing cycle.

6.1 Failed Payments

If a payment fails, we may suspend your access to the Services until payment is received. You are responsible for ensuring your payment information is current and accurate.

7. Cancellation and Refund Policy

7.1 How to Cancel

You may cancel your subscription at any time through: - iOS: Your Apple ID settings - Android: Google Play Store settings - Web: Your account settings at blazeactivate.com

Cancellation will take effect at the end of your current billing period. You will retain access to BLAZE Activate until then.

7.2 Refund Policy

•             Free Trial: No charge if cancelled before the trial ends

•             Monthly Subscriptions: No refunds for partial months

•             Annual Subscriptions: Refund requests within the first 14 days may be considered on a case-by-case basis

All sales are final. Because members receive immediate access to exclusive content, community, and live events upon purchase, we do not offer refunds or credits for partial periods, unused time, or missed participation.

You may cancel your membership at any time, but cancellation will only prevent future billing. Past payments are non-refundable. Any refunds awarded are at the Company’s sole discretion.

7.3 Subscriptions Through App Stores

If you subscribed through the Apple App Store or Google Play Store, their respective refund policies apply. Please contact Apple or Google directly for refund requests related to those purchases.

8. User Conduct

The Services may be used only for lawful purposes relating to personal development and activation content.

8.1 Community Guidelines (Wildfire Collective)

You are solely responsible for your conduct in the Wildfire Collective community. By participating, you agree to:

•             Create a welcoming environment. Treat everyone with respect.

•             Be kind. Healthy debates are natural, but kindness is required.

•             Keep everyone safe. Bullying of any kind is not allowed.

•             No discrimination. Degrading comments about race, religion, culture, sexual orientation, gender, or identity will not be tolerated.

•             No self-promotion. We do not allow promotions of your own business, brands, spam, or irrelevant links to third-party sites.

•             Report issues. If you see harassment or inappropriate behavior, contact our community admins immediately.

All contributions you make to the community will be accessible to other members. By participating, you acknowledge that failure to abide by these guidelines may result in your account being suspended or removed.

8.2 Prohibited Activities

You are prohibited from:

•             Accessing data not intended for you or logging into accounts you are not authorized to access

•             Attempting to probe, scan, or test the vulnerability of the system or breach security measures

•             Interfering with service to any user or network, including via virus, overloading, flooding, spamming, or crashing

•             Scraping or harvesting data from the Services

•             Using automated systems (bots, robots) to access the Services

•             Sharing your account credentials with others

•             Downloading, copying, or recording activations for redistribution

•             Using the Services for any commercial purpose without authorization

•             Reverse engineering or attempting to extract source code

Violations may result in immediate termination of your account and may result in civil or criminal liability.

9. User Information and Privacy

You are solely responsible for the information you provide when registering for the Services. You warrant and represent that all information is current and accurate and will be kept up-to-date.

If you register for the Services, you will be asked to provide certain information including a valid email address.

10. Username, Password, and Security

You are responsible for maintaining the confidentiality of your username and password, and are responsible for all uses of your account whether or not authorized by you.

You agree to immediately notify the Company of any unauthorized use of your account.

If you wish to have someone else use your device, always log out so no other individual will have access to your account.

11. Intellectual Property

11.1 Company Property

BLAZE Activate, the BLAZE Method, the HEAT Method, Wildfire Collective, His Voice Collection, FIRE Theory, and all related trademarks, trade names, logos, and branding are the exclusive property of Wildfire Enterprise, LLC and Dr. Barbara J. Kinney.

All content within the Services — including audio activations, scripts, frameworks, graphics, course materials, and documentation — is protected by copyright, trademark, and other intellectual property laws of the United States and other countries.

11.2 Your License

You are granted a limited, non-exclusive, non-transferable license to access and stream content for your personal, non-commercial use only.

11.3 Restrictions

You may NOT: - Copy, reproduce, download, or distribute any content - Sell, modify, or create derivative works based on our content - Use our trademarks or branding without written permission - Remove any copyright or proprietary notices - Share activations with non-subscribers - Record, screen capture, or rip audio content - Teach, reproduce, or distribute the BLAZE Method, HEAT Method, or any proprietary frameworks without written permission

Unauthorized use of intellectual property may result in legal action.

12. BLAZE Live and Live Events

12.1 Live Sessions

BLAZE Live sessions are included with your subscription and occur monthly. Sessions are conducted via video call (Zoom or similar platform).

12.2 Recording Policy

Live sessions may be recorded for replay purposes for subscribers who cannot attend live. By participating, you consent to being recorded.

If you participate in a hot seat or coaching portion, you consent to your voice and likeness being included in the recording and potentially used in marketing materials (with identifying details removed or with your explicit permission).

12.3 Participation Guidelines

•             Arrive on time for live sessions

•             Mute yourself when not speaking

•             Be respectful of other participants

•             Follow community guidelines during live events

13. Confidentiality

13.1 Your Information

Information you share within the Wildfire Collective community and during BLAZE Live sessions should be treated as confidential by all participants. However, the Company cannot guarantee the confidentiality of information shared in group settings.

13.2 Marketing Use

The Company may use anonymized success stories and testimonials (with identifying details removed) in marketing materials, website, and social media. If you wish to opt out of this, please contact us at support@wildfireenterprise.com.

14. Results and Guarantees

BLAZE Activate provides activation content, frameworks, and community support for personal development.

Results vary by individual. While we provide evidence-based techniques and proven frameworks, your results depend on your commitment, consistency, and follow-through.

The Company does not guarantee specific outcomes, income levels, relationship changes, or life transformations. Testimonials reflect individual experiences and are not typical results.

15. Technical Requirements

For optimal use of the Services, you are responsible for:

•             A compatible device (smartphone, tablet, or computer)

•             Reliable internet connection

•             Updated app version (for mobile users)

•             Working audio capabilities

•             For live sessions: working camera and microphone, quiet private space

The Company makes no guarantees as to the quality of your streaming experience. Quality depends on your connection speed, device, and bandwidth.

16. Warranty Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE SERVICES ARE FREE OF VIRUSES OR HARMFUL MECHANISMS.

THE COMPANY MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ACCESSED THROUGH THE SERVICES.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, YOU UNDERSTAND AND AGREE THAT NEITHER THE COMPANY NOR ANY OF ITS AFFILIATES, SUBSIDIARIES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, REPRESENTATIVES, CONTRACTORS, OR AGENTS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES RELATING TO OR RESULTING FROM YOUR USE OF THE SERVICES.

THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES FOR ERRORS, OMISSIONS, INTERRUPTIONS, DEFECTS, DELAYS, LOST PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, AND OTHER TANGIBLE AND INTANGIBLE LOSSES.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE DAMAGES ARE CLAIMED UNDER CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

COMPANY’S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, REGARDLESS OF THE CAUSE OF ACTION, WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

18. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE COMPANY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND PARTNERS FROM AND AGAINST ANY LOSS, LIABILITY, CLAIM, ACTION, OR DEMAND, INCLUDING REASONABLE LEGAL FEES, ALLEGING OR RESULTING FROM:

•             Your use of the Services

•             Your participation in the community or live events

•             Any content you post or share

•             Your breach of these Terms of Service

•             Your violation of any third-party rights

19. Termination

19.1 By You

You may terminate your subscription at any time through your account settings. Cancellation prevents future billing but does not entitle you to refunds for past payments.

19.2 By Company

The Company reserves the right to suspend or terminate your account immediately if you:

•             Violate these Terms of Service

•             Are disrespectful, threatening, or abusive to staff or community members

•             Engage in prohibited activities

•             Fail to pay subscription fees

•             Use the Services in ways that could harm the Company or other users

Termination may occur without notice and without refund.

20. Dispute Resolution

Any disputes arising from these Terms of Service or your use of the Services will be resolved through:

1.          Direct communication with the Company

2.          If unresolved, mediation in Jackson County, Missouri

3.          Governed by the laws of the State of Missouri

You irrevocably consent to the exclusive jurisdiction of the courts located in Jackson County, Missouri in connection with any action arising out of these Terms of Service.

21. General Provisions

•             Nothing in this Agreement creates a joint venture, partnership, employment, or agency relationship between you and the Company.

•             If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

•             The failure of the Company to exercise any right does not constitute a waiver of such right.

•             You may not assign these Terms or any of your rights or obligations without written consent.

•             These Terms constitute the entire agreement between you and the Company regarding the Services.

23. Acknowledgment and Consent

By creating an account, subscribing to BLAZE Activate, or using the Services, you acknowledge that you have read, understood, and agree to these Terms of Service.

You confirm that:

•             You are 18 years or older (or 13+ with parental consent for limited access)

•             You understand BLAZE Activate is not therapy or medical treatment

•             You are voluntarily using the Services

•             You agree to the subscription, cancellation, and refund policies

•             You agree to the community guidelines

•             You consent to the use of anonymized information for marketing purposes (you may opt out)
